The amount of time is takes to complete the probate process in Florida depends on the type of estate, the size of the estate and it’s complexities. Typically, formal probate administration can take as little as six months to as long as two years. For estates worth less than $75,000 that have no debut, summary probate administration can be filed which can be as short as 30 to 60 days.

Estimated Probate process timeline
- File for Probate: Within 10 days of learning of death, the original Will is filed in the Florida county where the deceased died.
- Granting Letters of Administration: Approximately 60 to 90 days (if not contested).
- Notice to Creditors: Notices are typically published for two weeks and creditors have 90 days from the notification date to file claims.
- Proof of Death to Probate Court: Up to 90 days for formal probate administration from notice to creditors (month 2 to 4).
- Inventory of Assets: Typically takes placed during months 3 to 8 of the process.
- Answer Creditor Claims: Pay or object within 30 days of receipt of the claim; typically takes placed during months 6 to 12 of the process.
- Final Discharge: Settlement of claims and payment of taxes; Typically takes placed during months 9 to 18 of the process.
